What do we do in this area?
Consumer law is a body of rules that protects individuals in an economically weaker position against sellers and providers in the goods and services market. The fundamental legislation in Turkey is Law No. 6502 on Consumer Protection and it grants consumers elective rights, withdrawal options, and free application channels.
When you purchase a defective good; you can choose one of the rights: refund, replacement with a non-defective equivalent, free repair, or a price reduction. Correctly determining the deadlines and the competent authority — whether it's an arbitration committee or a consumer court — determines the fate of the claim.
Your Elective Rights and Deadlines
In liability arising from defective goods, the consumer may choose any of the rights: rescission of the contract (refund), replacement with a non-defective equivalent, free repair, or a price reduction; the seller is obliged to fulfill this preference. Reasonable periods and maximum repair times are observed for replacement and repair requests. If the defect appears within six months from delivery, the goods are presumed to have been defective at the time of delivery — the burden of proof shifts to the seller. The statute of limitations is generally two years from delivery; different periods may apply for hidden defects and cases of gross negligence.
Distance Sales and Right of Withdrawal
In purchases made over the internet, phone, or social media, the consumer can generally exercise the right of withdrawal within fourteen days without stating any reason; the seller is obliged to refund the payment. Exceptions exist, such as custom-made products, perishable goods, and opened hygiene products. If no prior information was provided, the withdrawal period is extended. Similar protective provisions also apply to door-to-door sales, timeshare, and package tour contracts; reviewing the contract texts prevents loss of rights.

Frequently Asked Questions
Can I assert my rights if I don't have a receipt/invoice?
An invoice simplifies proof, but it is not the only evidence; purchase can also be proven with bank records, cargo printouts, correspondence, and witnesses.
Can the seller say "no returns on discounted items"?
No, if it's a defective good — your elective rights apply equally to discounted items. The right of withdrawal, however, can be exercised in distance sales regardless of any discount.
What if the seller doesn't comply with the arbitration committee's decision?
The decision has the nature of a judgment; you can collect it by initiating enforcement proceedings. At this stage, enforcement law tools come into play.
